These Terms of Service and Privacy Policy describe how How To Student, LLC (“How To Student,” “we,” “us,” or “our”) provides its services and collects, uses, protects, and discloses information. By accessing or using How To Student, you agree to these Terms of Service and acknowledge the practices described in this Privacy Policy.
About How To Student: How To Student is an education technology platform that provides AI-powered personalized learning tools for students, educators, schools, and school districts. Our services may include standards-aligned instruction and practice, personalized tutoring through text and voice, assessments, ACT and SAT preparation, essay feedback, progress tracking, learning analytics, teacher and administrator dashboards, accessibility features, and other educational tools. Our Platform may be made available directly to individuals or through schools, districts, educational organizations, or other institutions.
Agreement to These Terms: These Terms apply to our websites, applications, AI tutoring experiences, school and district services, and related products and services collectively referred to as the “Platform.” By accessing or using the Platform, you agree to these Terms. If you use the Platform through a school, district, employer, or other organization, additional agreements between How To Student and that organization may apply. If there is a conflict concerning the treatment of student data between these Terms and a written agreement with a school or district, the applicable written agreement will control. If you do not agree to these Terms, you should not use the Platform.
Eligibility and Student Accounts: The Platform is designed for students, educators, parents, schools, and other authorized users. Individuals who create accounts independently must meet any minimum age requirements applicable to the service and their jurisdiction. Users under 18 should use the Platform with the involvement or permission of a parent, guardian, school, or other authorized educational institution as applicable. Children under 13 may use How To Student when access and collection of information are appropriately authorized by a parent, guardian, school, or school district as permitted by applicable law. When a school or district provides access to the Platform, it may create or authorize accounts for students, educators, and administrators. You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account. You may not impersonate another person or use another person's account without authorization.
Educational Services: How To Student may provide standards-aligned personalized learning and practice, AI-powered text and voice tutoring, teacher-assigned and student-selected learning activities, ACT and SAT preparation and diagnostics, practice tests and assessments, and essay and writing feedback. The Platform may also include progress tracking and performance analytics; teacher, school, and district dashboards; intervention and learning-support tools; multilingual and accessibility features; and other educational services introduced from time to time. Features may differ depending on a user's account type, institution, subscription, location, or service configuration. We continually improve the Platform and may add, modify, or discontinue features.
Educational Outcomes: How To Student is designed to support learning, but educational performance depends on many factors outside our control. We do not guarantee any particular grade, test score, admission result, academic outcome, or improvement in performance. Any examples, case studies, averages, or reported outcomes reflect particular users or implementations and should not be interpreted as guarantees of future results.
Artificial Intelligence: The Platform uses artificial intelligence to provide tutoring, explanations, practice questions, feedback, recommendations, assessments, and other educational experiences. AI systems can make mistakes. Responses may occasionally be incomplete, inaccurate, or inappropriate for a particular educational context. Students and educators should exercise judgment when using AI-generated information and should verify important information when appropriate. How To Student is intended to support learning rather than replace teachers, counselors, parents, professional advice, or independent student work. Users may not use the Platform in ways that violate their school's academic-integrity rules or other applicable policies.
Acceptable Use: You agree to use the Platform only for lawful and authorized purposes. You may not use the Platform in violation of applicable laws or regulations, attempt to gain unauthorized access to any account, system, network, or data, interfere with or disrupt the security or operation of the Platform, or circumvent usage limits, access controls, or security protections. You may not upload malicious software or harmful content, or use automated systems to access the Platform in a manner that places an unreasonable burden on our services. Except where permitted by law, you may not reverse engineer, scrape, copy, extract, or reproduce the Platform. You may not use Platform content to develop or train competing products or services without authorization, or redistribute proprietary educational content except where expressly permitted.
You may not share account credentials with unauthorized users, impersonate another person, use the Platform to harass, threaten, exploit, or harm another person, or use the Platform to facilitate academic dishonesty. We may investigate suspected misuse and may restrict or terminate access where reasonably necessary to protect users, schools, How To Student, or others.
School and District Use: When How To Student provides services to a school, district, or other educational institution, we process student information only for purposes connected to providing, maintaining, securing, supporting, and improving the educational services authorized by that institution, subject to applicable law and our agreement with the institution. Schools and districts retain control of education records and student information provided to How To Student as described in their agreements with us and applicable law. Where applicable, How To Student may act as a “school official” or similar service provider under the Family Educational Rights and Privacy Act (“FERPA”) and process education records under the direction and control of the school or district. We do not sell student personal information. We do not use student personal information obtained through a school or district for targeted advertising.
We do not build commercial advertising profiles of students using school-provided student information. Schools and districts may request access to, correction of, export of, or deletion of student information in accordance with applicable law and their agreements with us.
Children's Privacy and COPPA: How To Student is committed to protecting children's privacy. The Children's Online Privacy Protection Act (“COPPA”) applies to certain online collection of personal information from children under 13. When permitted by COPPA, a school or school district may authorize How To Student to collect and process information from students under 13 when the Platform is being used for the educational purposes authorized by the school. Information collected under school authorization is used for the educational service and related operational purposes, not for unrelated commercial purposes. Where parental consent is required directly, we may obtain verifiable parental consent before collecting personal information from a child. Parents, guardians, schools, and districts may contact us to request information about our data practices or, where applicable, to review or request deletion of a child's personal information.
Information We Collect: The information we collect depends on how the Platform is used.
Account and Profile Information: Depending on how you access the Platform, we may collect your email address; school, district, class, grade level, or course information; your role as a student, teacher, administrator, parent, or other user; and information necessary to provide access to the Platform.
Educational and Learning Information: We may collect educational and learning information generated through use of the Platform, including assignments and activities, assessment and practice-test responses, scores and results, skills and standards practiced, learning progress, and time spent on activities. This information may also include tutor conversations, questions submitted by users, AI-generated feedback and instructional interactions, essay or writing submissions, performance by subject, skill, standard, or category, and teacher or school assignments and feedback.
Voice and Audio Information: When users choose voice-based tutoring or other audio features, audio may be transmitted to How To Student and our service providers as necessary to process the interaction and provide the feature. We use voice interactions to operate the tutoring experience and associated educational functionality. We do not use student voice data for targeted advertising.
Technical and Usage Information: We may automatically collect technical and usage information, including device and browser type, IP address, operating system, log and diagnostic information, dates and times of access, and the pages or features used. We may also collect information necessary to detect fraud, abuse, security incidents, or technical problems.
Information Provided by Schools and Other Organizations: Schools or districts may provide information necessary to create accounts, roster students, manage classes, assign educational content, integrate with school systems, or provide reporting. This may include information received through student information systems, single sign-on systems, learning-management systems, assessment systems, or other school-authorized integrations.
Payment Information: If you purchase a paid service directly from us, payment information may be processed by third-party payment processors. How To Student generally does not receive or store full payment-card numbers.
How We Use Information: We may use information to provide and operate the Platform, create and maintain accounts, personalize educational content and tutoring, and generate practice activities, explanations, feedback, and recommendations. We may also use information to track progress and learning outcomes, provide reports to students, educators, schools, and districts, enable school-authorized integrations, and provide accessibility and language features. We may use information to respond to support requests, maintain the security and reliability of the Platform, detect misuse, fraud, or technical issues, and develop and improve educational features. We may conduct internal analytics and research using information as permitted by applicable law. Information may also be used to comply with contractual and legal obligations and to protect the rights, safety, and security of users, schools, How To Student, and others.
Where appropriate, we may use aggregated or de-identified information that does not reasonably identify an individual to evaluate and improve our services, understand educational outcomes, conduct research, and develop product features. We do not use student information processed on behalf of schools or districts or children's personal information to create advertising profiles or for targeted advertising.
AI Service Providers: Certain Platform features rely on artificial-intelligence, cloud-computing, speech-processing, authentication, database, analytics, communication, security, and other technology providers. Information may be transmitted to these service providers when necessary to provide the applicable feature. We require service providers handling personal information on our behalf to process it for authorized purposes and subject to appropriate privacy and security obligations. We do not authorize service providers to use student information processed on behalf of schools or districts or children's personal information for targeted advertising or unrelated commercial profiling.
When We Disclose Information: We may disclose information in the following circumstances:
Service Providers: We may provide information to companies that perform services on our behalf, such as cloud hosting, artificial-intelligence processing, authentication, communications, analytics, payment processing, security, and technical infrastructure. These providers may access information only as necessary to perform services for us and subject to applicable contractual and legal requirements.
Schools and Educational Institutions: For school-managed accounts, educational information may be made available to authorized teachers, administrators, districts, or other school personnel.
At Your Direction: We may disclose information when a user, parent, school, or other authorized party directs us to do so.
Legal and Safety Reasons: We may disclose information where reasonably necessary to comply with applicable law, regulation, subpoena, court order, or other legal process; protect the safety or rights of users or others; investigate fraud, abuse, or security threats; or protect the rights and property of How To Student.
Business Transactions: If How To Student is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, information may be transferred as part of that transaction subject to applicable legal protections. Student information remains subject to applicable contractual and legal restrictions following any such transaction.
No Sale of Student Personal Information: How To Student does not sell student personal information. We do not disclose student personal information for targeted advertising. We do not use information collected from students through school-authorized use of the Platform to create advertising profiles unrelated to the educational service.
Data Retention and Deletion: We retain personal information only for as long as reasonably necessary for the purpose for which it was collected, to provide the Platform, to meet contractual requirements, to comply with applicable law, or to protect the security and integrity of our services. We do not intend to retain children's personal information indefinitely. For school-managed accounts, retention and deletion may also be governed by our agreement with the applicable school or district and its instructions. When information is no longer reasonably necessary, we delete it or de-identify it in accordance with applicable legal, contractual, and operational requirements. Some information may remain temporarily in secure backups or where retention is required by law, necessary to resolve disputes, protect security, prevent fraud, or enforce agreements.
Data Security: We maintain administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, disclosure, alteration, loss, or misuse. These safeguards may include encryption in transit and at rest, access controls, authentication protections, monitoring, logging, and restrictions on personnel access. Access to personal information is limited to personnel and service providers who require access for authorized purposes. No online service can guarantee absolute security, and we cannot guarantee that unauthorized access or security incidents will never occur. If we identify a security incident involving personal information, we will investigate and provide notifications where required by applicable law or contract.
International Processing: How To Student is based in the United States. If you access the Platform from another country, information may be processed or stored in the United States or other locations where our service providers operate. Where required, we take appropriate measures relating to international transfers of personal information.
Privacy Rights: Depending on where you live and the nature of your account, you may have the right to request access to your personal information, correction of inaccurate information, deletion of personal information, a copy or export of certain information, or information about how your personal information is used or disclosed. Certain rights may be subject to exceptions under applicable law. For school-managed accounts, students and parents may need to direct requests concerning education records to their school or district. We will assist schools with appropriate requests as required by law and our agreements. To submit a privacy request, contact hi@howtostudent.com. We may take reasonable steps to verify the identity and authority of the person making a request before providing access to or deleting information.
Intellectual Property: The Platform, including its software, interfaces, designs, branding, instructional systems, proprietary questions, diagrams, graphics, and other materials created by How To Student, is owned by How To Student or its licensors and is protected by applicable intellectual-property laws. Subject to these Terms, we grant authorized users a limited, non-exclusive, non-transferable, revocable right to use the Platform for personal or authorized educational purposes. Nothing in these Terms transfers ownership of How To Student intellectual property to users.
User Content: Users may submit text, essays, responses, documents, questions, audio, or other materials to the Platform (“User Content”). You retain any ownership rights you have in your User Content. You grant How To Student a limited right to host, process, reproduce, and otherwise use User Content as reasonably necessary to provide, secure, maintain, and improve the Platform and to satisfy our legal and contractual obligations. For student information, including information processed on behalf of schools or districts, this right is limited by applicable law and our agreements with schools and districts. You represent that you have the right to provide any content you submit to the Platform.
Feedback: If you voluntarily provide suggestions, ideas, or feedback about the Platform, we may use that feedback to improve our products and services without obligation to compensate you. This provision does not grant us ownership of student education records, User Content, or other personal information.
Payments and Subscriptions: Some Platform features may require payment. Prices, subscription periods, renewal terms, cancellation terms, and any applicable refund rights will be presented at the time of purchase or included in an applicable agreement. Payments may be processed through third-party payment providers. Unless otherwise stated in a separate agreement, fees are non-refundable except where required by law. School and district purchases are governed by the applicable order form, proposal, purchase order, contract, or other written agreement.
Third-Party Services and Integrations: The Platform may connect with third-party services such as authentication systems, student information systems, learning-management systems, assessment providers, or other educational platforms. Use of those third-party services may also be governed by their own terms and privacy policies. How To Student is not responsible for third-party services that are outside our control.
Suspension and Termination: You may stop using the Platform at any time. Where account-deletion functionality is not available directly within the Platform, you may request deletion by contacting hi@howtostudent.com. We may suspend or terminate access where reasonably necessary because of a violation of these Terms, security concerns, fraudulent or unlawful activity, misuse of the Platform, nonpayment where applicable, or a request from the organization responsible for a school-managed account. For school-managed accounts, termination and data handling may also be governed by our agreement with the applicable institution.
Disclaimer of Warranties: To the fullest extent permitted by applicable law, the Platform is provided on an “as is” and “as available” basis. We make no guarantee that the Platform will always be uninterrupted, error-free, or completely accurate, or that use of the Platform will produce any particular educational result. Nothing in this section limits warranties or rights that cannot legally be excluded.
Limitation of Liability: To the fullest extent permitted by applicable law, How To Student and its officers, employees, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Platform. To the fullest extent permitted by law, our aggregate liability arising from the Platform will not exceed the greater of the amount paid by the applicable user for the Platform during the twelve months preceding the event giving rise to the claim or $10. These limitations do not apply where prohibited by law. Separate agreements with schools, districts, or other organizations may provide different liability terms, in which case those terms will control for that relationship.
Changes to the Platform: We may modify, update, add to, or discontinue portions of the Platform from time to time. Where reasonably practicable, we will provide appropriate notice of material changes that substantially affect users' rights or the handling of personal information.
Changes to These Terms or Privacy Policy: We may revise these Terms or Privacy Policy to reflect changes in our services, technology, business practices, or legal requirements. When we make changes, we will update the “Last updated” date at the top of this page. If a change materially affects how we use personal information, we will provide additional notice or obtain consent where required by applicable law. Continued use of the Platform after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by law.
